Colorado man to be freed early now in immigration custody

State Reps. Paul Rosenthal and Dave Williams have written a letter asking Gov. John Hickenlooper to grant a pardon to Rene Lima-Marin as a possible legal remedy for the 38-year-old Aurora man who was ordered released from prison Wednesday only to be taken into custody by immigration officials who could possibly deport him to his native Cuba.

Lima-Marin seized the opportunity.

His wife, Jasmine, said Lima-Marin checked in with immigration officials every few months after he was mistakenly released from prison in 2008 but deportation was not a concern then.

Lima-Marin was brought to the U.S. when he was two years old by his parents, who fled from Cuba during the 1980 Mariel boatlift, according to the Denver Post.

Rene Lima-Marin was sentenced to 98 years in prison for robbing two video stores in 1998, CNN reports.

A Colorado inmate once released due to a mistake is getting freed again, and this time he's going back to a life he built the first time he was freed.

Lima-Marin came to the US from Cuba when he was 1 year old, according to Jasmine. Lima-Marin was then released on parole in 2008.

Aarapahoe County District Court Judge Carlos Samour Jr. agreed, saying in the 165-page decision, "It would be utterly unjust to compel Lima-Marin, at this juncture, to serve the rest of his extremely long sentence".

"His case was unique in that sense", Diego said. "The U.S. government may decide to just add them to the list".

He was sentenced to back-to-back, or consecutive, sentences on eight convictions, for a total of 98 years.

"Everyone is completely devastated", his Denver-based attorney, Kimberly Diego, said. He was mistakenly released on parole in 2008.

A judge on Tuesday ordered Lima-Marin's release, saying it would be "draconian" to keep him in prison and that he had paid his debt to society.

The detention of a Cuban immigrant set to rejoin his family after he was mistakenly released from prison, then put back, has raised questions about whether more people from the island nation will be deported from the United States now that relations between the two countries have thawed.

Lima-Marin started his prison term in April 2000, after being found guilty of multiple counts of kidnapping, burglary, aggravated robbery and use of a deadly weapon during commission of a crime. It is noted that no shots were fired and no one was injured in any of the robberies that Lima-Marin committed.

In preparation for Lima-Marin's release on Wednesday, a Criminal Justice Information Services review determined Lima-Marin possibly had an ICE detainer.

Samour also criticized "the government's conscience-shocking deliberate indifference" when it accidentally released a man and didn't notice the error for six years.

It's not clear whether Lima-Marin, who was ordered deported while in prison, will be returned there since Cuba would still need to agree with the USA government on him being included on a list of people to be deported. The detainer was later confirmed, according to a statement from the Colorado Department of Corrections obtained by the Denver Post.
