ICJ unanimously stays Jadhav's execution till final verdict

It also told Pakistan to give consular access to India to meet Jadhav.

When India appealed to ICJ and initiated proceedings against Pakistan for allegedly violating Article 36 of the Vienna Convention on Consular Relations, Pakistan argued that the court doesn't have jurisdiction over this bilateral dispute.

Saying that the matter, prima facie, falls under its jurisdiction, the court obeserved that India has presented sufficient evidence to demonstrate that Jadhav was at risk of being executed before they could complete the hearing in the case.

He included that India ought to have been allowed consular access according to Vienna tradition.

Pakistan and India have a history of bitter relations, and Jadhav's death sentence has further strained ties.

Pakistani Prime Minister Nawaz Sharif scheduled a national security meeting on Friday to discuss the court order.

India had moved the UN's highest judicial body against the death sentence, after Pakistan ignored its repeated requests for consular access to the 46-year-old former navyman. He said justice has prevailed in the matter.

Baglay said it means that until the court issues a final decision in the case, "Sri Kulbhushan Jadhav can not be executed by Pakistan".

"I think the court thought it appropriate to clarify that this order is binding". Not to mention, India was waiting for the verdict with abated breath.

The case - a rare foray for the two South Asian nations into the worldwide courts - has highlighted the recent sharp upsurge in tensions between the nuclear-armed rivals.

The two countries are battling it out in the global court amid a sharp escalation in tension over ceasefire violations by Pakistan, terror attacks in Jammu and Kashmir and the recent mutilation of two Indian soldiers by Pakistanis.

Pakistan argued that Jadhav's rights weren't breached and that the court didn't need to issue an urgent order to stay his execution because it wasn't imminent.

India has called on ICJ for an emergency hearing on Monday to suspend Pakistan's military court's death sentence to former navy officer.

The Kulbhushan Jadhav episode has exposed the real face of India to the world for its involvement in terrorism, terror financing, subversion and spying activities in a sovereign state of Pakistan.

Pakistan's attorney general's office said the order did not affect the final outcome of the case. Today, the court agreed to the contentions and asked Pakistan to hold off the execution of Mr Jadhav till it reached its final verdict. The ICJ also ordered Pakistani authorities to inform it of all measures taken to execute its judgment.

The ICJ, earlier, ordered Pakistan to halt the execution of the Indian spy until a final decision is reached.
