UN court to rule on Indian 'spy' facing execution

The Congress on Thursday welcomed the verdict of the International Court of Justice on Kulbhushan Jadhav and hoped the government will continue to mount pressure on Pakistan to implement the decision in order to save the former Navy officer's life and bring him back.

Swaraj, meanwhile, tweeted about how the order had come as a relief to Jadhav's family, and how Indian government under PM Modi would leave no stone unturned to save Jadhav.

India had moved the UN's highest judicial body against the death sentence to Jadhav after Pakistan ignored its request for consular access to the former navyman 16 times.

But in the meantime, as the court considers whether to take up India's case, New Delhi asked the tribunal to order a stay of execution until the end of the legal battle. India termed that the confession of Jadhav was forcibly taken by the military while in captivity and he was tried by a military court in Pakistan. I would like to congratulate the Ministry of External Affairs. The verdict will be given after taking into account the arguments delivered by India and Pakistan.

Pakistan does not accept the International Court of Justice's jurisdiction in matters related to national security, its Foreign Office said today after the United Nations court stayed the execution of Indian national Kulbhushan Jadhav.

Jadhav's case is the latest flash-point in the tensions between Pakistan and India. We are grateful to Mr Harish Salve for presenting India's case so effectively before ICJ.

Moreover, Pakistan argued with India over the issue of not being able to prove the difference in Jadhav's passport that bears a Muslim name.

India told the ICJ that immediate steps must be taken to stop Pakistan's from carrying out the death sentence of Jadhav. He said Pakistan has already informed the ICJ that it does not accept its jurisdiction. The attorney general also reiterated that "the ICJ's verdict in this case is binding for both India and Pakistan".

While India asserted that Jadhav was kidnapped from Iran where he was involved in business activities after retiring from the Indian Navy, Pakistan claims to have arrested Jadhav from its restive Balochistan province. The Court also notes that Pakistan has given no assurance that Mr. Jadhav will not be executed before the Court has rendered its final decision.

While reading out the court verdict, Judge Ronny Abraham said the decision of the 11-judge bench was unanimous. And therefore, Harish Salve argued that death sentences should be stayed immediately.
