Attorney: Officer 'did what he had to do' in driver shooting

St. Anthony Police Department officer Jeronimo Yanez, who was charged with second-degree manslaughter, was covered nationally and led to weeks of protests in St. Paul and Minneapolis after he fatally shot Philando Castile, 32, last July.

Ramsey County District Judge William H. Leary III on Tuesday granted the jury's request to view again videos of the traffic stop, as captured by the dashboard camera in Yanez's squad vehicle, and the Facebook Live post of the shooting's bloody aftermath filmed by Castile's girlfriend, Diamond Reynolds, who was in the passenger seat next to him.

Closing arguments are set to begin on Monday.

Jurors returned to court briefly Tuesday morning to re-watch two key videos in the case.

The defense said that Yanez, 29, reacted to the presence of a gun and was trained to preserve his own life in the face of imminent danger, pointing out that traffic stops are unsafe and officers need to think quickly. He urged a jury to clear the officer.

Prosecutors insisted Yanez never saw a gun and had plenty of options short of shooting Castile, an elementary school cafeteria worker they say was never a threat.

But during closing arguments on Monday, Yanez's defense team said Castile reached for his gun when he was told not to.

That BCA interview does show some discrepancies that the prosecution is depending on - such as Yanez saying he saw an "object" but not definitively saying it was a gun, as he did while on the stand.

Officer Jeronimo (yeh-RON'-ih-moh) Yanez is charged with manslaughter in Castile's death, which came just seconds after Castile informed the officer he was carrying a gun.

Noting that there was no damage to Castile's pocket or gun, Paulsen said that Castile's finger could not have been on the gun when he was shot.

He also argued Yanez could have taken steps short of shooting.

"He did what he was supposed to do", the prosecutor said.

The defense's own use-of-force experts said they think Yanez was right to shoot.

Reynolds said last week that she showed the video because she did not trust police. There is shouting, and Yanez screams "Don't pull it out!" before he fires seven shots into the vehicle.

"Culpable negligence" is a high standard, the jury instructions stated: More than ordinary or "gross" negligence, "It is gross negligence coupled with an element of recklessness".

Yanez killed Castile after pulling him over for a broken taillight July 6. He testified forcefully Friday that he saw Castile's gun and that Castile disregarded his commands not to pull it out of his pocket.

The shooting drew widespread attention after Castile's girlfriend streamed the gruesome aftermath on Facebook.

For the two counts of risky discharge of a firearm, jurors will need to decide whether the officer discharged his firearm under circumstances that endangered Reynolds and her daughter, Dae-Anna.

Gray immediately said he wanted to "get rid of that theory".

In closing, Gray told the jury, "It's not that hard of a case".

During the trial, Reynolds said she and Castile had used marijuana, and a subsequent autopsy found traces of the drug in his blood. "I did not want to shoot Mr. Castile at all", he replied.
