Cosby jury sent home after deliberating 4 hours

Bill Cosby returns to the courtroom following a break in his trial Monday in Norristown Pa. A former Temple University employee alleges that Cosby drugged and molested her in 2004 at his home in suburban Philadelphia. The defense team rested after just

Numerous jurors were expressionless during testimony, but a few were smiling and chuckling when they entered the courtroom on Monday afternoon to receive final instructions from Steven T. O'Neill, the presiding Montgomery County judge.

Jurors began deliberating at Bill Cosby's sexual assault trial on Monday after a weeklong proceeding in Pennsylvania that saw prosecutors and defense lawyers paint starkly different portraits of the once-beloved comedian. "With rhetorical dilemmas to resolve".

"Hopefully, you will have the last two words in this case, and I pray those words are not guilty", McMonagle said to the jury.

Cosby is accused of drugging and sexually assaulting Andrea Constand at his home near Philadelphia in 2004.

Earlier on Monday, Montgomery County Judge Steven O'Neill asked Cosby if he had had a chance to talk to his lawyers and if he made the decision on whether to testify or to call character witnesses.

McMonagle cast blame on the media for giving Cosby's accusers - who now number 60 - a forum.

" 'We're not ideal, are we?' he said, pausing and looking at Camille Cosby, 73".

Cosby's wife, Camille, appeared in court for the first time Monday morning, entering and exiting on her husband's arm and sitting through McMonagle's closing argument.

The defense strategy focused on highlighting inconsistencies in Constand's past statements about the timing of the alleged assault and pointing out that she remained in contact with Cosby for weeks after the night in question. She slipped into the courtroom while the judge was addressing the audience and the attorneys. McMonagle said that while the comedian had been unfaithful to his wife, he didn't commit a crime. Cosby testified over a decade ago as part of that lawsuit, eventually settling with her for an undisclosed sum.

On Monday, the question hanging over the trial was whether the TV star himself would testify. Legal experts and courtroom observers generally dismissed that suggestion as a bluff, perhaps created to throw prosecutors - who ended with a lot of momentum - off balance.

Only one person took the witness stand on the sixth day of the trial and it was a police detective.

Cosby, the famed comedian, did not testify in his own defense, and his defense rested after calling just one repeat witness for further questioning.

Steele recounted how both Constand and Cosby had referred to pills the entertainer had offered to Constand as her "friends".

As jurors watched Steele closely, Cosby faced forward away from the prosecutor and the jury.

Phone records showed she made no such call in January, he said, and instead show she only called Cosby's phone numbers in NY.

"This ain't right!" bellowed McMonagle.

Jurors also once again heard a recorded phone call between Cosby and Constand's mother, Gianna Constand, during which Cosby can be heard asking if his alleged victim is still interested in pursuing a career in broadcasting before offering to pay for her to go to graduate school.

Defense attorney Brian McMonagle told the jury that the two were lovers who had enjoyed secret "romantic interludes" and that the 2004 encounter was consensual.

"It's a relationship", he said, in a voice that sounded street-wise and tough.

For the prosecution's closing statement, Steele argued that Cosby's own statements showed his guilt.

Constand said she was "mistaken" when she made those statements to police. Constand - an athletic, 6-foot-tall college basketball staffer - said they made her dazed and groggy, and unable to say no or fight back when Cosby went inside her trousers. At the time, she was director of operations for the women's basketball team at Cosby's alma mater, Temple University. In his statement to police, Cosby says he gave Constand Benadryl after she complained of tension and trouble sleeping, and describes the sexual act that followed as consensual. Adding weight to the allegations was the revelation in 2015 that Mr Cosby in a deposition for a 2005 civil suit filed by Ms Constand had admitted to obtaining quaaludes to help him in his pursuit of sex with women. "I remind you, you worked a full day". "She spent a lot more time trying to forget what happened than trying to remember that night". A prosecution expert testified that such assertions amounted to "rape myths".

Constand, under the influence of the drugs and who briefly lost consciousness, could not and did not give consent, he said.

Instead of a lover, Steele asserted that Cosby is a criminal.

As he described reaching into Constand's trousers, Cosby testified, "I go into the area that is somewhere between permission and rejection".

"You do what you do to her, and then you leave?"
