A United States judge declared a mistrial Saturday in Bill Cosby's sexual assault case with the jury deadlocked on whether the disgraced star drugged and molested a woman in 2004, as prosecutors vowed to seek a retrial.

An eighth woman withdrew her lawsuit and a federal judge dismissed a ninth accuser's case, finding her complaint inadequate.

Yet the fundamental potential flaw in the case will remain: Constand's inconsistent statements to police about matters such as the date and circumstances of the alleged assault, which she says took place in 2004 at Cosby's gated estate in tony Elkins Park, Pennsylvania.

Constand told prosecutor Kristen Feden she was unable to stop the sex attack because her body was "limp" - the result, she claimed, of the unidentified pills Cosby suggested she take to help her "relax".

Prosecutors plan to retry the comedian on sexual assault charges.

Constand knew Cosby through her job at Temple University in Philadelphia, and he invited her to his Cheltenham home. But Allred, who represents Kirkpatrick and 32 other accusers, said she hopes he will reconsider.

O'Neill grew testy on the bench as he questioned McMonagle's requests to end the trial without a verdict.

Steele declined comment on a statement from Cosby's wife, Camille, which called him "heinously and exploitively ambitious".

Jurors also asked for, and received, a definition of reasonable doubt, the threshold that prosecutors must cross to win a conviction, and reviewed testimony from Constand and her mother about phone conversations they had with Cosby after the encounter. "Cosby is fortunate he has the money to get a proper defense", he said.

"Mr. Cosby's power is back. It has been restored".

Cosby broke barriers as the first black actor to star in a network show, "I Spy", in the 1960s and created the top-ranked "Cosby Show" two decades later, starring as kindly Dr. Cliff Huxtable. He also found success with his "Fat Albert" animated TV show and starred in commercials for Jell-O desserts. His lawyer says Cosby and Constand were lovers sharing a consensual sexual encounter.

More than 60 women have accused Bill Cosby of sexual assault since the '60s. During the more than 50 hours of deliberations, the jury not only asked for a rereading of statements Cosby made about his admitted use of Quaaludes with women, they also wanted to see Constand's phone records. She accused Judge Steven T. O'Neill, who oversaw the case, of "arrogantly" siding with the prosecution. "I t's important for the jury to be informed that there are more accusers, and if those accusers allege same or similar facts", she said.

He reminded prosecutors and the defense that "a mistrial is neither vindication nor victory for anybody". "Do they want to save Cosby, or do what the first jury couldn't do, which was convict him?"
