Deadlock in Cosby trial, jury told to keep at it

As the jurors quit for the night Wednesday, O'Neill praised their diligence as they weigh charges that could put Cosby in prison for the rest of his life. Before the impasse, the sequestered jury of seven men and five women had paused deliberations six times to revisit testimony or ask for clarity on the phrasing of one of the charges.

After hearing the judge's statement instructing them to try again, jurors walked out and crying could heard in the courtroom.

After three days and 28 hours of debate, the group had asked to revisit almost every critical piece of evidence from the trial that began almost two weeks ago - ranging from Cosby's 2005 deposition and police statement, in which he denied drugging and molesting the case's central accuser, Andrea Constand, to Constand's own recollections of the 2004 night she said he attacked her.

Defense lawyers during the trial emphasized discrepancies in Constand's statements to police in 2005 in an effort to undermine her credibility.

In it, he claimed Constand showed no ill effects from the 1½ Benadryl pills he gave her to help her relax and that she never objected to his behavior during the encounter. She says the incident happened at Cosby's home near Philadelphia in January 2004.

Constand was challenged by Angela Agrusa, one of Cosby's attorneys.

Commonwealth exhibits 27 through 43 comprise a wider portion of Cosby's deposition from more than a decade ago. Two questions asked to review parts of Cosby's account to authorities, and two asked to rehear Constand's account and testimony.

The jury said Thursday it's deadlocked on charges that Cosby drugged and violated a woman at his home in 2004. In those interviews, Cosby admitted to sexual contact with Constand and said they had previously had a romantic encounter.

Testimony revealed Constand, who was 31 at the time of the incident, did not report the allegations to police until a year later, in January 2005.

"Each of you has a duty to consult with one another and to deliberate with a view to reaching an agreement, if it can be done without violence to your individual judgment, " he said, reading from Section 2.09 of Pennsylvania law for jury instructions. Cosby, 79, has pleaded not guilty to three charges of aggravated indecent assault.
