Deliberations resume in police officer's manslaughter trial

Closing arguments are set for Monday, June 12, in a Minnesota police officers manslaughter trial in the death of a black motorist.

Yanez, 29, has been charged with second-degree manslaughter and two counts of reckless discharge of a firearm in the shooting of 32-year-old Castile on July 6, 2016, in Falcon Heights, Minn.

Seventy-four seconds is the amount of time that elapsed between the moment Yanez turned on his squad auto lights to the moment he fired the seventh and final shot into Castile's vehicle.

In that Facebook video, Castile - bleeding heavily - insists that he hadn't been reaching for his gun, which he had a permit to carry.

Meanwhile, supporters of Castile also gathered Tuesday at the St. Paul courthouse where the jury was deliberating.

"I thought it went splendid", one of Yanez's attorneys, Earl Gray, said of the defense's two-day case.

ST. PAUL, Minn. (AP) — A Minnesota police officer who fatally shot a black motorist seconds after the man informed him he was carrying a gun "did what he had to do" in a thoroughly justified use of force, a defense attorney argued during closing arguments.

Prosecutors called several witnesses to try to show that Yanez never saw the gun and acted recklessly and unreasonably.

He said this evidence shows that Castile was "stoned under marijuana" when he was pulled over by Yanez.

Paulsen asked the jury to consider what might have happened if Yanez, when told of the gun, would have stepped back a few feet to better assess the situation.

There's just too much doubt to whether or not Yanez saw Castile's gun, Paulsen told the jury. He reminded the jury that a bullet hit Castile in what would have been his trigger finger - but there was no bullet damage around his pocket where he had the gun.

The judge denied the jury's request to get transcripts of squad vehicle audio and of Yanez's statement to investigators the day after the shooting.

He also contested the state's argument that Yanez should have told Castile that he resembled a robbery suspect from four days prior.

"You didn't say firearm", Assistant Ramsey County Attorney Rick Dusterhoft said of Yanez's BCA interview.

Paulsen said Castile was paying attention and denied reaching for his gun.

The jury also re-watched video shot and livestreamed on Facebook by Castile's girlfriend, Diamond Reynolds. (Yanez) fired seven rounds into that auto. The officer's conduct was reasonable, he said.

In his rebuttal, Paulsen reiterated to jurors that there was no credible evidence Castile was under the influence of marijuana and one can not conclude he was under the influence simply because THC was in his system.

As Paulsen concluded his closing statements, the judge instructed the jurors that "culpable negligence" is a high level of negligence - gross negligence coupled with recklessness.

The judge issued detailed instructions to the jury.

The 15-member jury includes two black people.

Yanez is charged with second-degree manslaughter, punishable by up to 10 years in prison, and with two lesser counts of endangering Reynolds and her then-4-year-old daughter for firing his gun into the auto near them. The rest are white.
