For Bill Cosby, 2nd sex assault trial ahead

Bill Cosby arrives at the Montgomery County Courthouse during his sexual assault trial Friday

Former federal prosecutor David Weinstein said Cosby's celebrity nearly certainly played a role in the jury's deliberations, perhaps to convince "two or three jurors that it's impossible to convict Dr. Huxtable, to convict Fat Albert. that he couldn't have done this awful thing".

Bill Cosby walked out of court a free man Saturday - not because he was cleared of sexual assault charges - but because a jury decided that it could not reach a verdict on charges that he drugged and molested a woman at his home outside Philadelphia in early 2004. Constand stared straight ahead.

According to the documents, lawyer Dolores Troiani asked Cosby: "When you got the Quaaludes, was it in your mind that you were going to use these Quaaludes for young women that you wanted to have sex with?" When we got there we didn't have security and people were diving on our cars.

In more than a dozen notes to the judge, the jurors asked to revisit huge chunks of trial testimony, including Constand's account from the witness stand, her statements to police from 2005 and Cosby's sworn depositions taken in 2005 and 2006, when Constand filed a civil lawsuit against him. The jurors could not reach a unanimous decision after more than 50 hours of deliberation, announcing they were hopelessly deadlocked. "They are yours and yours alone", he said. She woke up the next morning in his home with her sweater bunched up and her bra undone, the affidavit says.

Constand was the Temple University women's basketball team manager, and Cosby was a significant donor to the school, as well as a member of the board of trustees.

Cosby thanked fans and supporters as he left court Friday.

One of Mr Cosby's lawyers, Brian McMonagle, applauded the decision. Did the jury have trouble navigating the three felony indecent sexual assault charges? The jury is made up of four white women, six white men, one black woman and one black man.

"The defamation case is this clever way of saying, If I say you raped me and you say it didn't happen, then you're defaming me by calling me a liar", he said. Our job is to follow the evidence where it takes us.

In a recorded deposition, the TV star confessed to plying women with sedatives before having sex with them. The admissions smashed the image he had built as a moralizing public figure and as the upstanding paterfamilias in the wildly popular 1980s and '90s sitcom "The Cosby Show".

Cosby himself didn't comment, remaining stoic as the judge declared a mistrial, but Andrew Wyatt, his spokesman, declared the star's "power is back". As such, the defense may not call him for the second trial if they think he's a loose canon or unreliable.

Cosby's supporters had hoped that a not-guilty verdict might tarnish the broader pool of accusations that have been leveled against him and stained his legacy.

"This is what happens, juries are stuck when a prosecutor seeks to put someone in prison for things that are simply not presented in the courtroom", said Angela Agrusa, one of Cosby's lawyers, after the mistrial was declared. Several showed up in the courthouse to support Constand each day.

Cosby told investigators in Pennsylvania that he gave Constand Benadryl and that the encounter was consensual.
