Gov't wants more time to address second travel ban ruling

The administration has already appealed that ruling, but has not asked for it to be heard on an expedited basis - so likely on the court's fall calendar.

The San Francisco court's ruling is the latest in a string of legal decisions against the Trump administration over the ban, which targets visitors and immigrants from several Muslim-majority countries.

The 4th Circuit had earlier ruled against the ban but on different grounds, insisting it violated the First Amendment by being "directed at a single religious group". It ruled based on immigration law, not the Constitution.

While the president has broad authority over immigration, the judges said, to invoke that authority in this case, Trump would have to show the entry of citizens from the six countries would harm the U.S. He made no such showing, they said. "Further, the [Executive] Order runs afoul of other provisions of the INA that prohibit nationality-based discrimination and require the President to follow a specific process when setting the annual cap on the admission of refugees". "It does not provide any link between an individual's nationality and their propensity to commit terrorism or their inherent dangerousness".

"The President must make a sufficient finding that the entry of these classes of people would be "detrimental to the interests of the United States," the court order read.

In a follow-up question, the report noted that the court ruling cited the president's tweets from June 5 on the travel ban, as well as the administration's statement that the president's tweets are official statements. The 4th Circuit also allowed that portion of the order to take effect.

"Although President's Trump's cabinet may think otherwise, today's ruling affirms that judges in Hawaii are more than capable of applying our laws and Constitution to President Trump's risky policies".

That is because the measure is supposed to be temporary - barring the issuance of new visas to residents of six Muslim-majority countries for 90 days and suspending the US refugee program for 120 days so officials could review vetting procedures.

The 9th Circuit was the court that upheld the freeze on Trump's first travel ban, and it has since become a focus of the president's ire. And now, the fight is on the Supreme Court's doorstep.
