Jury to continue deliberations Tuesday in Cosby sex assault trial

In a fiery closing statement, defense attorney Brian McMonagle said the prosecution's key witness, Andrea Constand, had too many inconsistencies in her story to be a reliable witness.

Sworn in briefly outside the presence of the jury, Cosby told O'Neill that he did not intend to testify. They began deliberating at 5:25 p.m. on Monday and continued for about four hours into the night, and they continued deliberating at 10 a.m. on Tuesday.

"Who says something like that?" They asked the judge to repeat two different parts of Cosby's statements to authorities, asked the court to define the phrase "without her knowledge" in one of the charges, and asked to hear repeat testimony from the Canadian detective who interviewed Constand.

Cosby said before the trial that he did not plan to testify because of what could happen on cross-examination. Cosby did not admit to giving Quaaludes to anyone without their knowledge. He says she doesn't say 'yes.' He says he put his finger. Cosby's alleged fondling of Andrea Constand, her state of unconsciousness and her lack of consent.

Bill Cosby's wife, Camille, has arrived at court with him on the sixth day of his sexual assault trial. She slipped into the courtroom while the judge was addressing the audience and the attorneys. McMonagle said that while the comedian had been unfaithful to his wife, he didn't commit a crime.

ALLYN: Outside the courtroom, Cosby's spokesman, Andrew Wyatt, said those little details undercut the accuser's credibility.

Prosecutors say the famed comedian drugged and sexually assaulted Andrea Constand, a former Temple University employee, at his home near Philadelphia in January 2004.

Jurors started their deliberations late Monday after the defence earlier in the day wrapped up its case in a breathtaking six minutes - calling just one witness in Cosby's sex ssault trial. The document, which the detective labeled "Questions for Andrea", included some matters about her account that he had sought clarification on, including the question as to why she had gone to meet Mr. Cosby at a casino in CT. Legal experts and courtroom observers generally dismissed that suggestion as a bluff, perhaps created to throw prosecutors - who ended with a lot of momentum - off balance.

During seven hours on the witness stand, she revealed how she lost consciousness but was later "jolted" awake by Cosby abusing her.

As expected, Cosby did not testify and when the judge asked him if that was his choice, he responded in a loud voice: "Correct!"

During the trial, the prosecution called one expert who testified that victims' accounts are often disjointed and inconsistent, and another who said that Benadryl, in a high dose, could be a powerful sedative.

"This ain't right!" bellowed McMonagle. The implication is that she was after money from Cosby, one of America's wealthier stars. Other than in the Constand case, Cosby has never been criminally charged in any other alleged incident, and has denied them all.

In other cases, it was determined that the defense witness's testimony would have amounted to nothing more than hearsay. Instead, he was intent on persuading the jury that Constand was a "lover" of the comedian - not a victim.

In a surprising move, Steele also admonished the Montgomery County D.A.'s Office for not bringing charges against Cosby sooner, saying it was a "failure".

District Attorney Kevin Steele told the jury these words prove Cosby knew exactly what he was doing when he allegedly gave pills to Constand, telling her they were herbal relaxants. Adding weight to the allegations was the revelation in 2015 that Mr Cosby in a deposition for a 2005 civil suit filed by Ms Constand had admitted to obtaining quaaludes to help him in his pursuit of sex with women.

"All the fancy lawyering you have can't get you around your own words", Steele said.

Gianna Constand, the accuser's fiercely protective mother, testified that Cosby apologized over the phone to her and her daughter and offered to pay for her schooling.
