Video expected to be shown in Penn State pledge's death case

Eighteen students have been charged with a variety of offenses, from involuntary manslaughter to alcohol-related offenses - more than 1,000 counts in all. The fraternity has been banned by Penn State and some of its members face involuntary manslaughter, aggravated assault and or other charges.

Prosecutors at a preliminary hearing rolled surveillance tape of sophomore Tim Piazza after he attempted a binge-drinking challenge on February 2 and suffered a traumatic brain injury after several falls - while his would-be fraternity brothers failed to seek medical help for nearly 12 hours. The fraternity members appear agitated and at one point a shoving match erupts between two men. Foster and Gilmartin were granted early waivers, according to court documents, and were not in attendance. "We hope to develop more information during the preliminary hearing process, and beyond, that will demonstrate that numerous charges in this case are just not applicable to the conduct".

Attorney Rocco Cipparone Jr., who represents Michael Bonatucci (who faces eight charges in Piazza's death), said, "I know the Bonatucci family and Michael in particular, certainly feel empathy and sympathy for the Piazza family". Piazza was hospitalized and died the next day.

"You would have thought it was a fraternity reunion", Piazza family attorney Tom Kline told the New York Times. "He looked like a corpse". Prosecutors played about three hours of the chilling video captured by the fraternity's own security cameras. When the video started, Jim Piazza and his wife, Evelyn Piazza, left the courtroom.

Attorneys for the Beta brothers objected to having not had the chance to see the footage prior to the hearing.

"They did it before over and over again and people were sick every time", Parks Miller said. Scicchitano noted that the time stamp on the video was more than 30 minutes slower than the actual time of the events.

"This is about Tim Piazza, and Tim Piazza died, and there should be an absolute reverence in that courtroom", said Centre County District Attorney Stacy Parks Miller.

Piazza's initial fall down 15 stairs was not specifically recorded. They let him suffer for 12 hours. After 3 a.m., Piazza tried to stand but fell, hitting his head on the floor. "They should have been trying to get him help".

Piazza is also seen staggering around the foyer and hall, falling and rolling around on the floor. The brothers then carried him to a couch upstairs where they left him.

Investigators say the frat brothers waited 12 hours to call 911. EMS wouldn't arrive until 10:22 a.m. camera time. Student Ryan Foster sits on Piazza's legs in what he described to police as an attempt to keep him from moving, Scicchitano said. David Scicchitano testified, according to USA Today.

The court watched in silence as video from the frat house showed Piazza in an apparent state of inebriation. Shortly before midnight, a fraternity brother wrote on a group message that Piazza "might actually be a problem".

An official with the Centre County Court System says the plan is to hear from witnesses on all 18 defendants in one day.
