British photographer wins legal fight over 'monkey selfie'

Naruto David Slater

His lawyer, Andrew Dhuey, was not immediately available for comment.

The US court ruled animals can not own copyrights. He also said interest in the image had already helped animals in Indonesia.

Schwarz is with Irell & Manella in Los Angeles.

The long-running fight in court over who claims the sovereignties to the popular "monkey selfie" has been settled.

"We should perceive fitting major legitimate rights for them as our kindred worldwide inhabitants and individuals from their own countries who need just to experience their lives and be with their families". A three-judge board of the ninth Circuit heard oral contentions for the situation in July.

That's the kind of monkey that took the famouse selfie with Slater's camera. PETA had also promised to donate any proceeds from the monkey selfies if it won the case.

PETA disputed Slater's ownership, launching a legal battle arguing that Naruto was the author of the photo and therefore entitled to the copyright. The two have been in settlement discussions at least since August 7.

A monkey taking a selfie should've been nothing more than cute, but for one photographer, the picture turned into a nightmare that lasted for years. The 9th Circuit was considering PETA's appeal.

PETA filed an infringement lawsuit, arguing that Naruto took the picture and therefore owned the copyright.

It was not clear how much the photograph has been worth to Slater, who previously said that fewer than 100 copies of his self-published book had been sold despite the publicity.

The photos were taken during a 2011 trip to Tangkoko Reserve in Sulawesi, Indonesia, with an unattended camera owned by Slater.

The photo then went viral, and when Slater saw the picture on Wikipedia, he asked the website to stop using it without his permission.

Orrick ruled previous year that, under Ninth Circuit case law, animals do not have legal standing to bring lawsuits unless expressly provided for by statute.
