Supreme Court Bans Entry Of Firecrackers

Govt, authorities should consider encouraging display of fireworks through community participation rather than individual bursting of crackers, the SC said.

The court said the Education Departments in Delhi, Haryana, and Uttar Pradesh would take steps within 15 days to reach out to students to sensitise and educate them on the health hazards and ill-effects of breathing polluted air, including air polluted by fireworks. The bench said it would review its ban order after Diwali, depending on the air quality of the city, reported PTI.

It said the health of people in Delhi-NCR must take precedence over any commercial or other interest of the fire crackers manufacturers and a graded regulation was needed which would eventually result in prohibition. Now on Tuesday Supreme court once again raised an issue over the entry of crackers in Delhi-NCR. The environmentalists had sought courts intervention in passing orders for a ban on the sale of firecrackers due to a rising pollution.

This year SC passed an order to the Delhi police, to reduce the number of temporary licenses by 50 percent of those permitted in last year and the number licenses should not exceed by 500. "The area of distribution of the temporary licences is entirely for the authorities to decide", the bench said.

"The Delhi Police is directed to reduce the grant of temporary licence by about 50 per cent of the number of licence granted in 2016". The transportation of firecrackers to the Delhi and NCR banned on Sep 12th. It seems to us that the steps so far taken by the Government of NCT of Delhi are limited to issuing directions, which is merely paperwork. Similarly, the Delhi Police has issued directions that are hard to enforce such as restricting the time during which fireworks can be burst. "It is high time that governmental authorities realize that the cost of ill health (particularly among children) is far greater in psycho-social terms than in financial and economic terms".

"These are ad hoc measures that might be workable (if at all) only for the immediate future. The health of children should be of foremost concern in this regard", it said. The order is an interim arrangement as the Bench set up a Committee headed by Central Pollution Control Board (CPCB) chairman to study the harmful effects of firecrackers on human health and submit a report by December 31.

"...a complete ban on the sale of fireworks would be an extreme step that might not be fully warranted by the facts available to us".

"The suspension of permanent licences, as directed by the November 11 order, is lifted for the time being".
