Cowboys' Ezekiel Elliott Seeks Restraining Order to Get Back on the Field

NFLPA to request en banc rehearing of Elliott's case

A person with direct knowledge of the situation says attorneys for Dallas Cowboys star Ezekiel Elliott are set for an emergency hearing in federal court in NY as they try again to stop the running back's six-game suspension over domestic violence allegations.

The Cowboys are coming off their bye week this upcoming Sunday when they travel to take on the winless San Francisco 49ers, which they will have to do without the services of Elliott.

The request for a restraining order, as expected, was filed to the U.S. District Court for the Southern District of NY.

In a 38-page filing Monday, the NFLPA cited a disciplinary process "that has denied the Union and Elliott of fundamental fairness" and mentioned the "forthcoming" motion for a temporary restraining order and preliminary injunction.

It was on Wednesday that the Fifth Circuit Court of Appeals vacated an injunction that kept Elliott's suspension from being enacted and allowed the running back to continue to play, and in less than 24 hours the case was ordered back to NY. Should the current league-mandated six-game ban remain in place for its entirety, he would next return to the field on November 30 against the Washington Redskins with just five games remaining on the schedule in the 2017 season. However, court rules allow the NFLPA seven days to file a petition for an en banc rehearing in Texas, a hearing in front of the full panel of Fifth Circuit judges.

Monday morning, the National Football League responded to that request, saying the NFLPA hadn't demonstrated "extraordinary circumstances" necessary for an en banc rehearing. Because of this, the injunction will not be lifted until the Fifth Circuit Court of Appeals decided on this new motion.

On Monday morning, the NFLPA acknowledged that his suspension was in effect and he was not allowed at the team's facilities.

The NFL issued the suspension following an investigation into allegations of a domestic dispute involving Elliott.
