Jerry Jones reportedly made anthem statements to take on 'bad guy' role

Jones, owner of the Dallas Cowboys and stunt man, infamously said any player who disrespects the flag will not play-which also led to Jemele Hill's suspension. The popular sports host has unloaded his issues with the Dallas Cowboys for punishing players over protesting the National Anthem.

Speaking on 105.3 The Fan in Dallas on Tuesday, Jones said the players could express themselves prior to the national anthem in a similar manner to how the team handled things before their September 25 game at the Arizona Cardinals. Two players, defensive linemen David Irving and Damontre Moore, raised fists at the end of Sunday's anthem.

Unlike the National Basketball Association, the NFL does not now have a rule that requires players to stand for the anthem. A local labor union has filed a complaint to the National Labor Relations Board against the Cowboys saying Jones' threats prevent allowable, "concerted activity" at work. While NFL teams are private businesses and not covered by the First Amendment, the use of publicly-funded stadiums and acceptance of government funding for pregame patriotic displays could bring legal liability.

Labor lawyers, though, feel the charge doesn't have much of a chance.

"This is a workplace issue", Jones said. "That's just not what they can do when it comes to concerted activities".

The argument that most fall back on is Jones' business "acumen" being responsible for the growth of the NFL, but the predominant factor in the NFL's ascendance to the top of our national consciousness is the league's TV contracts, and Pat Bowlen was the head of the NFL's television committee. In the past, those protections have only protected people from being punished for belonging to certain political parties but a creative lawyer might try to argue it covers protesting football players, too, he said. During the anthem, they stood arm in arm. However, if they were to kneel in protest of something such as the National Football League not having guaranteed contracts, that would be a different subject matter.

Some states have their own First Amendment-style protections, and they can include protection of political speech, Tushnet said. "The point is he is threatening anybody and everybody. Mr. Jones just got carried away being a rich guy and there's no laws he has to respect". The law here is that you have the ability to act with your co-worker.

Jones, who donated $1 million to Trump's inauguration fund, drew praise from the embattled president late on Monday. Jones might be confused.

In an interview with 105.3 The Fan on Tuesday, Jones made his stance on the matter clear. "Right now, it's all anticipatory, no action has been taken".

"The remedy for this stuff is to cease and desist", Green said.
