Supreme Court Dismisses Petition Seeking Stay On Padmavati's Release

A bench headed by Chief Justice of India, Dipak Misra, said statements made by persons holding power or high office about the movie is tantamount to "pre-judging" it before it is cleared by the Central Board of Film Certification (CBFC).

Bihar Chief Minister Nitish Kumar on Tuesday said Sanjay Leela Bhansali's film Padmavati will not be released in the state until the director has clarified his stand on the controversy, The Indian Express reported.

A bench headed by Chief Justice Dipak Misra dismissed a fresh petition that had sought an order to restrain the producers of the movie from releasing it overseas. "The remarks on the film have created an air of prejudice", the court said.

Several state governments, including Rajasthan, Madhya Pradesh, Gujarat, Haryana and Uttar Pradesh, have said they will not allow the release of the film Pdmavati as of now.

The bench, which also comprised Justices A.M. Khanwilkar and D.Y. Chandrachud, termed as "misconceived" the prayers sought by Sharma in his fresh petition and said that the court can not pre-judge a movie which is yet to be certified by the CBFC.

The irked bench, however, did not impose a cost on Sharma keeping in view the fact that he has been a practising lawyer of the apex court. On November 20, the court had dismissed another petition by Sharma seeking deletion of some scenes from the film.

The film by Bollywood showman Sanjay Leela Bhansali - which stars Deepika Padukone as former Mewar queen Padmini - has been slammed by Rajput groups for allegedly showing a dream sequence between the legendary figure and Mughal king Allauddin Khilji. BJP Madhya Pradesh chief Nandkumar Singh Chauhan called Bhansali a "sinner" for "tampering history", while CM Shivraj Singh Chouhan said Padmavati would not be released in MP even if cleared by the Censors.

Comedian Kapil Sharma, too, has his share of opinion regarding the fire and fury surrounding the most controversial film of the year "Padmavati". The release of the film, which was earlier slated for December 1, was deferred as the filmmakers were yet to procure a censor certificate.
