Police stayed on the shooting scene at East Park Place and Main Street for hours

Reports say Evans pulled Kays over for a traffic violation in Clark County when Kays opened fire and fled the scene.

A 79-year-old suspected drunken driver shot a state trooper in the head as the officer tried to handcuff him during a traffic stop in southern in, police said.

Indiana State Police Trooper Morgenn Evans pulled the driver of a 1999 Chevrolet Silverado truck over just after 7 the area of East Park Place and Main Street. Jerry Goodin said Wednesday. Trooper Evans was transported to the University of Louisville Hospital in Louisville, KY with non-life threatening injuries.

He faces charges of attempted murder and driving under the influence. When reporters asked Kays after the court hearing what happened the night before, he replied, "Well, I think I crossed the line".

Kays is now in custody after being arrested at his home.

"This is obviously no joking matter", Clark County Prosecutor Jeremy Mull said. At the time of the press release, it was not known if Trooper Evans' shots wounded Kays or if he was wounded by his own gun or debris from the shots fired.

Both the suspect and state trooper were transported to a local hospital for their injuries.

ISP said officers then saw Kays had a wound, which officials believe was from the earlier shooting.

Kays told investigators he shot the trooper because "he didn't want to go to jail", Goodin said.
