India's Supreme Court judges warn democracy is in danger

It was 11 am on Friday when a tweet spread like wildfire in the corridors of the Supreme Court of a possible Press conference to be held by the four senior-most judges at 4, Tughlaq Road, the official residence of Justice Jasti Chelameswar in an hour.

Justice Chelameswar told the media that they were "convinced that unless this institution is protected and maintain its requirements, democracy will not survive in the country or any country".

In the letter, they mentioned instances of cases with "far-reaching consequences for the nation and the institution" that were selectively assigned by the chief justice without any rational "basis for such assignment".

The four justices at Friday's news conference - Chelameswar plus Ranjan Gogoi, Madan Lokur and Kurian Joseph - are the most senior after Misra.

At the news conference, all the judges rubbished questions on whether they have broken ranks and said that they will start doing things which they do. Speaking on similar lines, Ravindra Babu said that an All India Judicial Services on par with the IAS should be constituted, while several MPs suggested live telecast of proceeding in the higher courts and the Supreme Court.

The chief justice is responsible for the roster.

The four "rebel" judges reportedly came up with their observation as they went public with complaints against India's chief justice, Dipak Misra.

"Our judiciary is reputed, judiciary is independent and it has credibility".

The rebellion also sprung from the fact that the bench constituted to investigate Judge BH Loya's death was not above suspicion. We owe a responsibility to the institution and the nation. We met CJI this morning, with specific request but we could not convince him.

"The Government of India has conveyed the need to make improvement on the draft MoP to the Secretary General of the Supreme Court vide letter dated 11".

A division bench of Justice Arun Mishra and Justice M.M. Shantanagoudar asked the Maharashtra government to file a reply and documents by January 15, the next date of hearing. "I think it is extremely serious and needs to be looked into carefully". The judges have also expressed dissatisfaction with the improper investigation into the mysterious death of special CBI judge Justice BM Loya, who was hearing a high-profile case at the time of his death.

Opposition parties today demanded a "thorough probe" into issues flagged by four Supreme Court judges over its functioning, prompting a strong reaction from the ruling BJP that accused its rivals of "politicising internal matters" of the judiciary. The listing of the petitions filed by Kamini Jaiswal and Campaign for Judicial Accountability and Reforms (CJAR) in what we have come to know as the "medical college bribery case" before judges who were directly involved with the verdicts granting medical colleges permission to operate raised a few eyebrows, to say the least.

The four judges did not provide details of their grievances during the press conference, but they released the letter which they had sent to Chief Justice Misra.
