NY subway bombing: Akayed Ullah pleads not guilty

A Bangladeshi immigrant was indicted Wednesday in the failed pipe bombing of the NY subway system last month.

Ullah faced five federal terrorism-related charges and three state terrorism-related charges last month, according to court documents.

Akayed Ullah, 27, who also suffered injuries in the blast, is also charged with providing material support to the Islamic State, conducting a terrorist attack on a mass transit system, bombing a public place, destruction of property with fire or explosives and using an improvised explosive device in furtherance of a crime. Ullah was indicted Wednesday, Jan. 10, 2018, in the failed pipe bombing of the NY subway system in December.

U.S. District Judge Richard J. Sullivan asked Ullah how he wanted to plead to the six-count indictment.

Akayed immigrated to the U.S. on a family visa in 2011. He answered, "Yes." When asked for his plea, Ullah responded, "At this moment, not guilty".

Ullah was the only person seriously injured when the government said he detonated the pipe bomb strapped to his body.

Defense lawyer Amy Gallicchio said Ullah, who is now held at the Metropolitan Correctional Center federal jail in Manhattan, needed medical attention for painful stitches that were "embedded" in his skin and for a medical dressing that hadn't been changed recently.

"In selecting this time and place, Ullah's alleged objective in the Port Authority bombing was painfully clear: to inflict as much damage as possible, and to strike fear into the hearts of New Yorkers in the name of ISIS". He was arrested soon after the pipe bomb failed to fully explode, though he was initially hospitalized after suffering burns.

Gallicchio said the defense would need 90 days to review discovery material in the case, which Turner said includes video of Ullah allegedly carrying out the attack, phone records, financial records, travel records and message logs from his electronic devices.

The judge said he may set a trial date at the next hearing, which was set for April 13. The president later demanded tightened immigration rules.

Prosecutors say Ullah wanted to cause carnage to avenge US aggression toward the Islamic State group.
