Hadiya's was an 'adjustment' marriage, will consider moving review plea: father

Hadiya a Hindu convert married a Muslim youth Shefin Jehan in 2016. The marriage was later annulled by the Kerala high court

The order also referred to Hadiya personally appearing before the Supreme Court on November 27 and admitting to her marriage with Shafin Jahan, who had challenged the High Court order that nullified the marriage. The Kerala High on May 24 annulled the marriage on a complaint by her father terming it as an instance of "love jihad". But she was presented in the court after her marriage.

Jahan had on September 20 approached the apex court, seeking the recall of its order directing the NIA to investigate the marriage. Allowing a plea filed by Hadiya's father, the HC flagged the role of extremist organisations in influencing her and instilling radical thoughts in her.

A three-judge Bench, headed by Chief Justice Dipak Misra, gave the ruling after NIA lawyer Maninder Singh told the Supreme Court that the agency's probe had nearly been concluded. Appearing for the NIA, lawyer Maninder Singh had submitted to the Supreme Court that the probe has nearly been completed. Her marriage with Shafin Jahan can not be annulled.

However, Hadiya's father in a last-ditch attempt to "save his daughter" from being "indoctrinated", filed an affidavit in the court claiming that attempts were made to take Hadiya to Syria and that she was "psychologically and physically abducted".

The apex court, however, allowed the National Investigation Agency to continue their investigation into the allegations of love jihad. Respondent No.9, Hadiya alias Akhila Asokan is at liberty to pursue her future endeavours according to law.

Last month the bench had said that the NIA couldn't probe the marital status of Hadiya.
