Judge Denies Cosby Defense Request For Mistrial

Flying in the face of the #MeToo movement Cosby's attorney slams accuser as 'con artist'

He says their encounter was consensual.

The Associated Press does not typically identify people who say they are victims of sexual assault unless they grant permission, which Constand has done.

During cross-examination, a defence attorney seized on inconsistencies in Dickinson's testimony and what she wrote in the book. Each of the women has alleged the same combination of pills which Cosby encouraged them to take as "relaxants" before he assaulted them while they were in a semi-conscious state. On at least one occasion, Constand said she rebuffed his advances, telling him she had no interest.

Cosby has said he gave Constand the cold medicine Benadryl and that she consented to a sexual encounter.

O'Neill had blocked the counselor, Marguerite "Margo" Jackson, from testifying at the first trial.

Bill Cosby leaves his sexual assault trial for.

In January 2004, Constand said, Cosby invited her to his house again to discuss her career options.

Thomas is rejecting a defense lawyer's suggestion she was seeking a share of the spotlight and trying to profit off her experiences.

Tom Mesereau: "She had a history of financial problems until she hit the jackpot with Bill Cosby".

It's the only allegation among dozens against Cosby that has led to criminal charges.

The judge says that Cosby's lawyers can bring it up.

Over the course of two days of testimony, Janice Baker-Kinney, the third accuser to be called as a witness in Cosby's felony sexual-assault retrial, painstakingly recounted her story of a foggy night involving drugs and rape.

Accuser Heidi Thomas stepped down from the stand earlier Wednesday, but not before firing a warning shot in which she said "I was to convict a serial rapist".

Cosby's attorneys are expected to cross-examine Constand, including about the almost $3.4 million settlement she received.

A former model told a jury Thursday that Bill Cosby raped her in 1982 after giving her a pill he claimed would ease her menstrual cramps but instead left her immobilized and unable to stop an assault she called "gross".

"Since this American citizen didn't adhere to Ms. Allred's ransom notice, she paraded in a stable of women to destroy his legacy, his career and reputation", Wyatt said.

"I trusted him because he's 'America's Dad, '" Lublin said. She said it was the rule, not the exception, that victims knew perpetrators.

"I didn't want to think about it, I didn't think of it as rape because I blamed myself" for not turning down the pills, she said.

Lawyer Gloria Allred watched from the courtroom gallery as her clients Lasha and Baker-Kinney testified.

Security was stepped up on Tuesday outside of the courthouse in suburban Philadelphia after a topless protester jumped over a barricade on Monday and ran toward Cosby.

His attack on Constand was a striking departure from the more subdued tone that Cosby's previous lawyer took at the first trial, which ended in a hung jury last spring.

The judge also barred a request made by Cosby's defense team to use a 2005 press release that Castor issued explaining why he didn't bring charges against Cosby.

She told the jury she has nothing to gain financially now by wanting him locked up.

Constand stiffed roommates on utility bills, racked up big credit card bills and operated a Ponzi scheme while running women's basketball operations at Temple University, where Cosby was an alumnus and trustee, Mesereau said. The next thing she remembers is coming to, feeling Cosby behind her, and his fingers inside her vagina.

Cosby spokesperson Andrew Wyatt on Thursday derided the five additional accusers who testified as "distractors" and "advocates for the prosecution and Andrea Constand".

The former model and aspiring actress is one of five additional accusers who are being allowed to testify in the retrial.

Bill Cosby's lawyers are scrutinizing the 2014 police statement of a woman who reported he drugged and molested her as a 17-year-old decades ago.

But one new detail has already emerged in the form of a settlement Cosby paid to Constand in 2006, according to The New York Times: $3.38 million.

A spokesman for Cosby told reporters Friday that they're confident he'll be found not guilty.

Testimony from these "prior bad acts" witnesses will be used to show that Cosby had a common pattern and did not make a one-time mistake in his assault of Constand, according to prosecutors.
