Apple, Samsung Face Off Again in New Patent Dispute Trial

The case is Apple Inc v Samsung Electronics Co, 11-cv-01846, US District Court, Northern District of California (San Jose).

Lee showed the jury a series of Samsung phones released before, shortly after and years after the iPhone's debut in 2007. "But that's why it's critically important for us to step back in time".

The ruling from this retrial is expected to serve as a crucial precedent for future patent suits, changing the dynamics for innovative technology and designs.

The retrial will determine the damages Samsung will need to pay after it was found guilty of violating Apple's patents way back in 2012.

Apple also included 2 utility patents covering its bounce-back scrolling and pinch-to-zoom features.

The trial is the latest in a long and ongoing dispute which Samsung estimates is worth around $28 million. It argues that customers were not only buying its handsets because of the design, but also due to their "functionality". The big deal here is going to be over Samsung paying damages for the total value of the device, or whether it's going to be a fee base on the parts of the iPhone that they reportedly copied.

"I agree with Samsung on this one", she said.

Honor 10 Announced : Beauty In AI
While Honor is the leading smartphone e-brand in China, it is expanding rapidly overseas with 100 per cent growth since inception. The front camera supports bokeh mode, and it also has support for studio lighting effects in a range of lighting conditions.

It's not the first time Apple has made this argument in court.

Later Koh admonished Quinn saying what he did was tantamount to jury nullification. Samsung's lawyers appealed the case, bringing down the compensation of $1 billion to $400 million in 2015 at the US Court of Appeals for the Federal Circuit.

As a quick refresher, the case centers around whether or not design patents are "powerful tools to keep competitors at bay or relatively limited in power", as CNET puts it.

As part of the earlier verdict, the Supreme Court noted that the article of manufacturer is "broad enough to embrace both a product sold to a consumer and a component of that product, whether sold separately or not". The glass is easily separated from the phone and doesn't cost much, Samsung has argued.

Apple argues Samsung's entire profits should be taken into account.

Apple claims that the Korean giant infringed on as many as three of its patents and that the asking amount is what Apple thinks is equivalent to the profit made by Samsung off its patent designs. The design patents that Samsung infringed concern the physical shape that would become the iPhone, the bezel, and the colorful grid of icons. Susan Kare, a GUI designer who was part of Apple's Macintosh design team and has since worked for Microsoft and IBM, will testify that the iPhone GUI can not be separated conceptually from the phone.
