B.C. files constitutional challenge of Alberta’s fuel restriction law

A federal Court of Appeal challenge led by First Nations is seeking to cancel the federal environmental certificate, which could send the project back to the drawing board.

With that deadline looming, B.C. business leaders flew to Edmonton last Thursday to show their backing for the project, which would almost triple the flow of diluted bitumen from the Alberta oilsands and increase tanker traffic sevenfold.

Notley said the lawsuit is just one of several tactics to create uncertainty over the Kinder Morgan pipeline project.

"We think the stock itself is pricing in a less than 25-percent chance of the project going ahead", said Matthew Murphy, an analyst with investment bank Tudor, Pickering, Holt and Co.

"The deal has to get done with Kinder if the focus is to get the pipeline in service by 2020", McConaghy says, noting the cost and delays involved in bringing in a third party.

"Albertans, British Columbians and all Canadians should understand that if the path forward for the pipeline through B.C.is not settled soon, I am ready and prepared to turn off the taps". "The other is gasoline or jet fuel to be used by citizens to move around freely", he said.

He added that constitutionally, provincial governments "can't use trade policy to punish one another".

Notley says Singh's opposition to the Trans Mountain pipeline expansion is premised on a lack of understanding of the economic stakes.
