Brett Kavanaugh Will Right the Course of the Supreme Court

5 faith facts on Trump’s Supreme Court pick Brett Kavanaugh — He’s Catholic conservative and has opined on abortion and birth control

And he is ready.

Senator Charles Grassley believes President Trump's supreme court nominee is well qualified for the job and critics will have trouble preventing his quick confirmation.

While Indivisible touts itself as a grassroots organization, it has received funding from Linkedin co-founder Reid Hoffman, who has donated tens of thousands of dollars to Democratic candidates and recently donated $1 million in May to the Democratic super PAC, Forward Majority Action.

Kavanaugh's nomination sets the stage for a brutal confirmation battle, a blueprint for which Republicans established in 2016 when they denied a hearing to Merrick Garland, Barack Obama's choice to fill the seat left vacant following the death of conservative justice Antonin Scalia. His opponents will contest this conclusion, but largely because they are focused less on what the law requires than on winners and losers, and they fear that the undoubtedly conservative Kavanaugh will rule against them in many contexts.

Sen. Bob Casey is the rare Democrat who opposes some abortion rights and who describes himself as "pro-life", but he opposed Trump's nomination for a reason unrelated to abortion and before he knew it was Kavanaugh.

Senator Bernie Sanders, an independent who caucuses with opposition Democrats, said Kavanaugh would serve as a "rubber-stamp for an extreme, right-wing agenda pushed by corporations and billionaires".

As a judge on the U.S. Court of Appeals for the District of Columbia Circuit, Kavanaugh dissented in 2011 from the appeals court's conclusion that Obamacare did not violate the U.S. Constitution.

The one would-be justice who would have brought a more diverse background to the court was Harriet Miers, a Texan with a law degree from Southern Methodist University and a close association with President George W. Bush. Will he safeguard ALL Americans' civil rights?

Karl asked Fallon if he and other Democrats are "entirely misstating" Kavanaugh's view of executive power, noting that in a 2009 Minnesota Law Review article, Kavanaugh explicitly said that Congress "might consider exempting a president" from criminal prosecution and investigations because there is "no constitutional protection". He routinely decides for the powerful against the powerless when safety, equality, consumer rights, the environment and workers protections are at stake.

If confirmed, how do you think Judge Kavanaugh's appointment will affect the ideological balance of the court? And many legal scholars on both sides doubt it will get very far.

Democratic Senator Chris Murphy of CT said on Wednesday that Trump, in choosing Kavanaugh, is "trying to rig a Supreme Court such that it will strike down protections for pre-existing conditions and he has a case ready to move to the Supreme Court to do just that".

"From one perspective", he wrote, assessing the abortion debate, "some disagree with cases that allow the Government to refuse to fund abortions and that allow the Government to impose regulations such as parental consent, informed consent, and waiting periods". Justice Sonia Sotomayor is the only former trial judge.

"In doing so, Kavanaugh invoked Chief Justice Charles Evans Hughes and the lessons of the court in the early 20th century: "(H) istory and precedent counsel caution before reaching out to decide hard constitutional questions too quickly, especially when the underlying issues are of lasting significance. But all have stood firm against GOP efforts to take apart the Affordable Care Act. It is unlikely that Kavanaugh would land at the outermost pole of the court, where Justices Clarence Thomas and Neil Gorsuch, Trump's first appointee, have aligned.

A Kavanaugh confirmation would spell a decisive shift to the right for the top judicial body.

During Senate hearings, Kavanaugh will undoubtedly be questioned about whether he would support overturning Roe v. Wade, the 1973 decision that established a woman's federal right to an abortion.

"Kavanaugh is perceived by many analysts to be less staunchly conservative than other judges on President [Donald] Trump's short list", he added.
