DHS Refuses to 'Reunite' Children with Adults Who Aren't Their Parents

There are as many as 2,900 more children five or older who remain in federal custody awaiting a July 26 reunification deadline, HHS Secretary Alex Azar said Thursday.

In court filings, the ACLU has said the government is asking for needless provisions for reuniting families that would not happen if the families had not been separated in the first place.

The ACLU said late Sunday the administration provided it with a list of 102 children under 5 years old and that "appears likely that less than half will be reunited" by Tuesday's deadline.

The infant is one of hundreds of children who have yet to be reunited with their parents, with many separated from their families under the Trump administration's recently rescinded "zero tolerance" family separation policy. Thirty children will not be reunited by Tuesday, for a range of reasons. An additional 20 children have purported parents with whom they can not be reunited because those adults have already been either removed from the United States or released into the country, which removes DHS and HHS's ability to force them to come get the children they claim are theirs. According to government attorneys, nine have parents who have already been deported, while an additional nine have parents that have been released from government custody in the United States.

Among the other remaining question marks is whether authorities can streamline their vetting process for the migrant parents - which ACLU attorneys have described as needlessly cumbersome - and whether the government can pass along the locations migrant families will be released from custody, so that charity groups can more quickly offer them support.

"The court has a range of options from significant fines to other types of relief", said ACLU attorney Lee Gelernt.

"I believe that they can still reunite some [more] individuals by tomorrow", Gelernt said during the hearing. Some parents are not eligible, the government said, because they have criminal records, were deemed to be unfit or, in one case, have a communicable disease.
