Secret recording reveals why Rosenstein hasn’t been impeached – and when he will be

The audio, released by MSNBC's Rachel Maddow and recorded at a closed-door California fundraiser, shows Nunes admitting that collusion with a foreign government is a crime before offering a very narrow definition of that crime.

The Mueller investigation is now looking at the extent of Russian intervention in the 2016 US Presidential election, and whether there was any collusion from the Trump campaign. "Devin Nunes is saying, 'I don't care what [special counsel Robert] Mueller finds, we're supposed to be a block on the Mueller process'".

As Kasie Hunt noted how the tape raises questions about whether the GOP as a whole will protect Trump "at all costs", Scarborough compared the House Intelligence Committee chairman and members of the House Freedom Caucus to the "useful idiots" who would apologize for America during the Cold War.

"The Senate would have to drop everything they're doing ... and start with impeachment on Rosenstein".

In the 40-minute recording, Nunes gives his candid thoughts on a variety of issues, from the Mueller investigation and the president's tweets, to why he thinks efforts to impeach Deputy Attorney General Rod Rosenstein should be tabled until after the confirmation of Supreme Court nominee Brett Kavanaugh.

"If we do not keep the majority, all of this goes away".

Asked about the the impeachment plans, Nunes told a questioner that "it's a bit complicated" because "we only have so many months left". "The question is the timing of it right before the election", Nunes added.

Rosenstein, who has overseen the special counsel investigation after Sessions recused himself from the probe, has faced harsh criticism from House conservatives who have accused the Justice Department of withholding key information from Congress and stonewalling congressional subpoenas. "But ultimately let's say the Portuguese came and brought her some stolen emails, and she made a decision to release those. It's a matter of, it's a matter of timing". Okay, now we have a problem, right? And then take the risk of not getting Kavanaugh confirmed. "Well, if that's the case, then that's criminal".

"I've said publicly Rosenstein deserves to be impeached", Nunes said.

"Like sometimes you love the president's tweets, sometimes we cringe on the president's tweets", he said, attempting to discredit Mueller's purported examination of Trump's inflammatory posts as part of his inquiry into possible obstruction of justice. Since Jeff Sessions is recused on the matter of the Russian Federation probe, the responsibility of deciding whether or not to fire Mueller, if Trump were to ask for this, falls to Rosenstein.
