Musk also confronted his "fateful" tweet on August 8 when he posted that he was taking Tesla private - a move he said he did not regret.

An employee fired from Tesla's Nevada battery factory filed a whistleblower complaint with the US Securities and Exchange Commission, accusing the company of spying on employees and failing to act after learning that a Mexican cartel may be dealing drugs inside the plant, his attorney said on Thursday. While the worst may be behind Tesla operationally, Musk said he worries that pressure from Tesla bears will continue as long as his company is public.

Choking up at times during the interview, Musk said his grueling work schedule has played havoc with his health and private life and forced him to take Ambien to sleep.

The news suggests that the company was under investigation well before Chief Executive Elon Musk tweeted that he had "secured funding" to take the company private at $420 a share. But Musk says he wasn't stoned at the time of the tweet.

The Times report said board members had raised concerns over his "workload but also about his use of Ambien", a sleeping drug. The newspaper reported, citing an unnamed source, that some board members have connected Musk's use of the medication to his after-hours tweeting.

Musk talked about his grueling work schedule, the struggle to crank out his company's first mass-market electric auto - the Tesla Model 3 - and the fallout over his public declarations about taking Tesla private.

Among Musk's explanations for the way he handled things is that he had seen his remarks as a good-faith effort to be transparent with his company's stakeholders.

Musk said while he's committed to being Tesla's chairman and CEO, he asked the interviewers if they have anyone that could do a better job to "please let me know".

Following reports Tesla had been issued a subpoena, shares of the auto company fell 3.3 percent to $336.40.

Tesla's chief also said his friends "are really concerned" about him.

In a statement to The Times that Tesla attributed to the board of directors, the company criticized what it called "false and irresponsible rumors" about the board's discussions.

Furthermore, the price of $420 a share was the result of a rounding up, and Musk made it clear that "he was not on weed".

Tesla's stock prices surged that day.

"Weed is not helpful for productivity".

The electric auto maker's stock was set for its worst day in almost five months as Musk's comments come at a time when federal regulators are pressuring Tesla's directors for details on how much information he shared with them.

One of the plaintiffs, Kalman Isaacs, says Musk falsely claimed funding to take Tesla had been secured to "completely decimate" short-sellers betting against the company.

Although Musk and Tesla have been dogged by production issues for months, often requiring him to sleep at his production facility, his problems ratcheted up last week when an ill-advised tweet triggered a federal investigation.
