Weinstein wins dismissal of criminal charge for alleged sex assault

TMZ reports that a judge has dismissed one of the three cases of sexual assault against Harvey Weinstein, this one from an actress named Lucia Evans.

Assistant District Attorney Joan Illuzzi-Orbon told the judge that prosecutors would not oppose dismissal of the count in the case involving Ms Evans.

Evans said in May that she would be pressing charges against Weinstein, telling the New Yorker, "At a certain point, you have to think about the greater good of humanity, of womankind".

Lucia Evans claims Weinstein forced her to perform oral sex on him in 2004, but new information revealed on Thursday casts doubt on Evans' story.

Weinstein's lawyer, Benjamin Brafman, told the judge he believes Evans lied both to the grand jury and to The New Yorker about her encounter with Weinstein.

Weinstein's legal team will have until November 16 to file further motions attacking the remaining charges against him.

The judge also released a letter from the district attorney's office to Brafman. Evans claims Weinstein forced himself on her, but the witness says otherwise. The friend said Evans later told her that she gave the entertainment mogul oral sex in exchange for an acting job after she met him at his apartment.

The defense says the emails do not reflect communications between a rapist and a victim, including one in which she wrote, "Your the one who makes it look good with your smile and handsome eyes".

Speaking outside court, Mr Brafman said that "while the crime of sexual assault is certainly serious, to falsely accuse someone of sexual assault is equally serious".

Although Brafman said he has "great respect" for the D.A.'s office, "I have deep regret that the thoroughness of the investigation did not prevent them from charging Mr. Weinstein with a crime he did not commit".

Mr. Weinstein was arrested in late may in NY, eight months after the publication of the first accusations of sexual harassment, sexual assault and rape aimed.

The 66-year-old father of five, out on a $1 million bail and forced to wear a Global Positioning System monitor, has long pleaded not guilty to six counts allegedly committed against three women in 2004, 2006 and 2013.

An attorney for Evans told reporters outside the court that the prosecution "jumped ship" and "ultimately she was caught between the middle of a feud between the NYPD and the DA's office", according to CNN.

The woman also told the detective - identified by Weinstein's lawyer as Nicholas DiGaudio - that sometime after Evans' office meeting with Weinstein, she suggested what happened was consensual, according to the letter.

The hearing comes a year and a day after The New Yorker first published allegations by one accuser in the case, Lucia Evans. The next hearing where Weinstein is scheduled to appear is set for 20 December.
