White House Must Reinstate Jim Acosta’s Credentials, Judge Rules

Ruling expected in CNN White House credentials case

A federal judge made a limited ruling Friday that the White House must immediately restore press access to CNN correspondent Jim Acosta on Fifth Amendment grounds.

US District Court Judge Timothy Kelly announced his decision on Friday morning after CNN sued the White House over the move.

CNN argued in its lawsuit filed Tuesday that the White House infringed on Acosta's First Amendment rights by revoking his access in response to a dispute over a press conference last week.

Acosta has clashed repeatedly with President Trump and press secretary Sarah Huckabee Sanders in briefings over the last two years.

Kelly - who was appointed by President Donald Trump - criticized how the White House handled the situation, saying that their decision to revoke Acosta's credential was "so shrouded in mystery that the government could not tell me. who made the decision", according to BuzzFeed News' Paul McLeod.

Ben Wizner of the American Civil Liberties Union (ACLU) said that the White House's attempts to silence Mr Acosta have backfired.

Acosta attempted to ask another question, but Trump wouldn't answer.

Kelly's decision is temporary and further hearings are expected to take place in the next few weeks to determine whether or not yanking the credential violated CNN and Acosta's First and Fifth Amendment rights. Though she originally cited Acosta's alleged physical behavior toward the intern, she now said he tried to "monopolize the floor" rather than "yield to other reporters".

Kelly rejected Team Trump's argument plenty of other CNN-ers still hold White House badges, noting that is not relevant to the issue of causing irrevocable harm to Acosta.
