The decision to deny certiorari was 6-3, with Chief Justice John Roberts and embattled new Justice Brett Kavanaugh siding with Justices Ruth Bader Ginsburg, Stephen Breyer, Sonia Sotomayor, and Elena Kagan, over the objections of Justices Clarence Thomas, Samuel Alito, and Neil Gorsuch. The legal profession erroneously believes that lower courts can grant standing to anyone so they can babysit the other branches on clear political questions, yet the Supreme Court refuses to babysit their own quite inferior courts.

Once we agree to legitimize judicial supremacy, we have lost our nation, regardless of the orientation of the Supreme Court. And despite the fondest dreams of their anti-abortion allies and the urging of Republicans in Congress, even Jeff Sessions's Department of Justice has done nothing after looking into it.

Abortion remains a hot button in the United States, where the Supreme Court legalized abortion in its 1973 Roe v. Wade decision, with many measures being implemented in recent years to complicate access to services to terminate a pregnancy. Abortion is not healthcare, and women's needs are better met by real, full-service medical locations, not abortion vendors. Kavanaugh took his seat in the second week of October, and his supporters have assumed he would vote in favor of restricting abortion rights when given the opportunity.
